What To Do After An Accident


Car accidents are an everyday occurrence in Tucson.  Our streets and freeways present a danger even to the most careful driver.  For this reason, it is always important to have good car and health insurance coverage that can cover your medical or disability expenses in case of an accident.

No one wants to be involved in an accident, but if you are unfortunately struck by a negligent driver please consider the following checklist of what to do after a car accident:


DO NOT LEAVE THE SCENE OF THE ACCIDENT

Leaving the scene of the accident constitutes a crime under Arizona law.


PROTECT YOURSELF

Do everything you can to avoid another accident with other motorists.  Move your car or yourself to a safe location nearby, if you can do so without further injury to yourself or your passengers.  Make sure that other drivers can see you, so that they can drive around you.


CALL THE POLICE

It is very important to report the accident to the local police department or the appropriate law enforcement agency with jurisdiction to investigate the accident.  Police reports are not admissible in court, but they are very helpful to insurance companies because liability, injuries, and insurance can be determined at times with the report.


DO NOT ADMIT LIABILITY

Tell the police the facts of the accident, but do not state that you were responsible for the accident.


IDENTIFY THE OTHER DRIVER AND WITNESSES

It is important that you obtain the name, address, telephone number, and insurance company information of every driver or car owner involved in the accident, including the name of the insurance and the policy number.  Also, write the license plate number of every car that was involved in the accident, and the driver’s license number of the parties who were involved in the accident.

If time permits, verify that the registration number of the individual vehicles match the license plate numbers of those vehicles.  

Witnesses will be important soon because insurance adjustors and/or lawyers will be speaking with those people whom you or the police are able to identify as witnesses.


TAKE NOTES OF THE ACCIDENT

Take short notes of the accident and the admissions and allegations of the individuals at the scene of the accident.  Note the time when the accident occurred, along with the weather and road conditions.  Make a sketch of the position of the vehicles before and after the accident, and the estimated travel speeds of the vehicles involved in the accident.


SEEK MEDICAL CARE

Please make sure that you and your passengers receive proper medical attention immediately after the accident.  Call the ambulance if you require emergency care.  Your wellbeing and that of your loved ones should be your priority.  Taking these steps will not only help you treat your injuries, but it will document your injury for your personal injury claim.


TRACK YOUR INJURIES AND PROPERTY DAMAGE

Make a note of all the injuries that you incurred as a result of the accident.  Write the name of every doctor and medical provider that treated you for your injuries.  Take pictures of the damage to your vehicle, and pictures of the accident scene if you can do so in a safe manner.  Capture all the vehicles involved and see if you can also depict points of reference and skid marks.
